Terms of Service.

The ground rules for using this site and any Fast Wombat products.

Who we are

Fast Wombat, LLC ("Fast Wombat," "we," "us"), based in Austin, TX. By using this site or our products, you agree to these terms.

Use of the site

This site is provided for informational purposes. You may browse it freely. You may not use it in any way that would damage, disable, overburden, or impair the site or interfere with anyone else's use of it.

Products and waitlists

Where we offer products or waitlists, additional product-specific terms may apply. Where those terms conflict with this document, the product-specific terms control.

Our apps

This section is the license agreement for our apps. It's an agreement between you and Fast Wombat, LLC — not with Apple. We alone are responsible for our apps and everything in them. Where you get one of our apps from a store other than Apple's App Store, that store's own rules apply as well.

License. We grant you a personal, non-transferable license to use our apps on Apple-branded devices that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, including through Family Sharing where that applies. You may not rent, lease, lend, sell, redistribute, sublicense, copy, decompile, reverse engineer, or disassemble one of our apps, or attempt to derive its source code, except to the extent the law expressly allows it.

Support. We're solely responsible for support and maintenance of our apps — email support@fastwombat.com and we'll help. Apple has no obligation whatsoever to provide any support or maintenance for them.

Warranty. We're solely responsible for any warranty on our apps, express or implied, to the extent it isn't disclaimed below. If an app fails to conform to an applicable warranty, you may notify Apple and Apple will refund what you paid for that app. To the maximum extent permitted by law, that refund is Apple's entire warranty obligation to you, and any other claims, losses, liabilities, damages, costs, or expenses arising from the failure to conform are our responsibility, not Apple's.

Claims. We, not Apple, are responsible for addressing any claim from you or a third party relating to one of our apps or your possession and use of it — including product liability claims, claims that an app fails to meet a legal or regulatory requirement, and claims arising under consumer protection or privacy law. Nothing in these terms limits our liability beyond what the law permits.

Intellectual property claims. If a third party claims that one of our apps infringes their intellectual property rights, we, not Apple, are solely responsible for the investigation, defense, settlement, and discharge of that claim.

Legal compliance. By using our apps you represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.

Third-party terms. You must comply with any applicable third-party terms when you use our apps — your wireless carrier's plan, for instance.

Apple's rights. Apple and Apple's subsidiaries are third-party beneficiaries of these terms. When you accept them, Apple has the right — and is deemed to have accepted the right — to enforce these terms against you as a third-party beneficiary.

Purchases

Some of our apps offer in-app purchases. On Apple platforms every purchase goes through Apple: Apple takes the payment, issues the receipt, and handles refunds. If you want a refund, request it from Apple — we can't issue one ourselves. Whatever an app charges, you'll see the price and what you're getting in the app before you're charged.

One-time unlocks. Where an app offers a one-time purchase that unlocks features permanently, it's exactly that: you pay once, and the features stay unlocked. You can restore the purchase at no additional cost on any device signed in to the same Apple Account — look for Restore Purchases in that app's settings.

Subscriptions. Where an app offers an auto-renewing subscription, the same mechanics apply to all of them. Payment is charged to your Apple Account when you confirm the purchase. The subscription renews automatically at the price for your plan unless you cancel it at least 24 hours before the current period ends, and Apple charges the renewal within the 24 hours before that. You can manage or cancel a subscription any time in your Apple Account settings; cancelling stops the next renewal and you keep access until the end of the period you've already paid for. Where a free trial is offered, any unused part of it is forfeited when you buy a subscription to the same content. The specific price, billing period, and any introductory offer are shown in the app before you subscribe, and are set out in that app's section below once the subscription is live.

Beta and pre-release builds

Several of our apps are in beta or pre-release testing, usually distributed through TestFlight. Beta builds are unfinished software: they change often, they can contain bugs, they can lose data, and we don't guarantee that a save or a setting made in one build keeps working in the next. A beta build may also stop working, or be withdrawn, without notice. Treat a beta run as something that may not survive an update. Where an app is in beta, we say so in its section below.

Roll Play

Roll Play is our app for iPhone and Android and is currently in pre-release testing. It connects to a public BoardGameGeek profile that you choose to link; you're responsible for the profile you enter, and you should only link a profile you're entitled to use. BoardGameGeek is a separate service we don't operate, control, or claim affiliation with, and it may change or become unavailable at any time. How we handle data in the app is described in our Privacy Policy.

Roll Play will be offered as an auto-renewing subscription, on the terms set out under Purchases above. While it's in pre-release testing there's nothing to buy; when the subscription goes live we'll name the price and the billing period here and in the app before you're charged.

Gravehoard

Gravehoard is our game for iPhone, iPad, and Mac and is currently in beta. There's no account.

Gravehoard will be free to play, with a single one-time purchase that unlocks its full feature set, on the terms set out under Purchases above. While the game is in beta everything is unlocked and there's nothing to buy. How we handle data in the game is described in our Privacy Policy.

Tilt Maze

Tilt Maze is our game for iPhone and iPad and is currently in beta. It's played by tilting the device, so it needs one with a working accelerometer. There's no account.

Tilt Maze is free to play, with a single one-time purchase that unlocks additional modes and features, on the terms set out under Purchases above. While the game is in beta everything is unlocked and there's nothing to buy.

Your progress and settings are stored only on your device. There's no sync and no backup, so deleting the app deletes your progress and we have no way to recover it. If you set one of your own photos as a background, it stays on your device — it's never uploaded, and we never see it. How we handle data in the game is described in our Privacy Policy.

AI features

Roll Play includes optional AI features that are off until you turn them on. AI-generated recommendations, plans, and insights are suggestions only — they can be inaccurate or incomplete, and they're not professional advice. Use your own judgment before relying on them. We don't guarantee the availability, accuracy, or continued operation of any AI feature.

Intellectual property

All content, branding, and software on this site are the property of Fast Wombat, LLC unless otherwise noted. You may not copy, modify, or redistribute it without permission.

Disclaimer

This site, our apps, and any preview products are provided "as is" and "as available," without warranties of any kind, to the fullest extent the law allows. We are not liable for any damages arising from your use of them. Nothing here limits any liability that can't be limited by law, or any right you have as a consumer that can't be waived.

Changes to these terms

We may update these terms from time to time. If we change anything material, we'll update the date at the top of this page.
